eMoviePoster.comDid you know... that we are VERY soon going to start charging SOME of our U.S. customers sales tax, with more states being added each month?Return to Did You Know Archive Added: 07/01/2019 On 6/21/18, the U.S. Supreme Court (in a narrow 5 to 4 decision) decided that the 50 U.S. states can charge sales tax on sales made from one state to another, even when the seller does not have a "physical presence" in that state (which was the old standard). This was a giant "win" for huge corporations like Walmart and Amazon, which already had a "physical presence" in all or most states, so they were already charging sales tax on Internet purchases. It is a giant "loss" for any merchant who only had a "physical presence" in one state (like eMoviePoster.com) and who do enough business in many states that they will now have to collect sales tax from their buyers (see below). It is also a "loss" for U.S. buyers, who now must pay sales tax on many Internet purchases. Taxes (both state and federal) are already at record highs. Those state and federal governments keep spending more and more money, and they will keep adding more and more taxes, and raising the ones they already have (and it is virtually a guarantee that over time the limits of the amount of business done that triggers sales taxes will lower and lower until eventually EVERY internet sale requires sales tax to be paid). But it is especially dreadful for yet another reason. Each state is rapidly passing their own law, and the wording is often VERY confusing. This means that we must deal with every state individually, for we sell enough in some states that we must collect sales tax there, and not enough in others, so we won't be collecting sales tax in those states. The very first state we will be collecting for is New Jersey, and lots more will be added soon, and we will send emails to all our customers in those states, announcing the change (and the sales tax will afterwards be automatically added to your total when you check out). THERE IS ONE VERY IMPORTANT EXCEPTION TO THIS, WHICH IS THAT, IF THE BUYER HAS A VALID "RESALE CERTIFICATE" FROM THEIR STATE, THEN WE DON'T CHARGE THEM SALES TAX. But you can only use your resale certificate number if the items you buy are being offered for sale (for example, you can't use it to buy posters to put on the walls of your business' office), and your resale certificate number MUST be on file with us before you complete the transaction. THEREFORE, IF YOU ARE ONE OF OUR U.S. CUSTOMERS, AND YOU HAVE A VALID "RESALE CERTIFICATE" FROM YOUR STATE, PLEASE EMAIL IT TO US IMMEDIATELY SO WE CAN PUT IN ON FILE AND NOT CHARGE YOU SALES TAX. If you currently DON'T have a valid resale certificate, but DO buy items from us to re-sell, then please immediately get one (and as soon as you have it, email it to us). If you want to know more about resale certificates, and how to get one, go here: https://www.salestaxinstitute.com/sales_tax_faqs/resale_certificate or here: https://blog.taxjar.com/resale-certificates-by-state/ And of course we will continue to update all our customers with new developments, both in this club and in emails to customers from specific states. And of course, this does not affect our non-U.S. customers, or those customers from states where we don't do enough business to have to collect sales tax.
